- On April 3, 2007, USCIS announced that the H-1B cap for FY2008 had been reached on April 2, 2008, the first day that H-1B petitions could be received for the FY2008 year. As of Monday afternoon (April 2, 2007), USCIS had received approximately 150,000 H-1B cap-subject petitions; there are only 65,000 H-1B numbers available each year. In accordance with its regulations, USCIS will subject any petitions received on April 2, 2008 or April 3, 2008 to a computer-generated random selection process; selected petitions will be processed and the rest will be rejected. It is still not known if the exemption (limited to the first 20,000) for H-1B petitions filed on behalf of aliens who have earned a masters degree or higher from the United States has also been exhausted.
